2. Membership.
Some functions of this Service may require you to register as a
member ("Member") by selecting a unique member identification ("Member
ID") and password, and providing certain information about yourself.
In registering to be a Member, you represent that you are of legal age
to form a binding contract, and agree to provide accurate, current,
and complete information about yourself as prompted, and to maintain
and promptly update the information to ensure that it remains accurate,
current, and complete. If you provide any information that Blingeasy.com
believes to be inaccurate or incomplete Blingeasy.com has the right
to suspend or terminate your account and refuse any and all current
or future use of the Service. Membership in the Blingeasy.com service
is intended for adults, and children under 13 may not obtain a Member
ID.
You agree to (a) keep your password confidential and to only log in
with your Member ID and password, (b) ensure that you exit from your
account at the end of each session, and (c) immediately notify Blingeasy
of any unauthorized user of your Member ID and/or password. You are
fully responsible for all activities that occur under your Member ID.
Blingeasy will not be liable for any loss or damage
arising from your failure to comply with this Section.
Photo Submissions
Blingeasy has complete discretion whether to accept or reject
your User Submission.
You retain all of your ownership rights in your User Submissions. By
submitting to Blingeasy, you hereby grant Blingeasy a worldwide,
non-exclusive and transferable license to use, copy, prepare or edit
your Photos.
You also hereby grant each user of the Website or other viewer of
the User Submission a non-exclusive right to use, reproduce,
distribute, prepare derivative works of, display and perform such
User Submissions, all for non-commercial and personal use.
You agree that you will
not: submit photos that are copyrighted, protected by trade secret
or otherwise subject to third party proprietary rights, unless you
are the owner of such rights or have permission from their rightful
owner to post the User Submission and to grant Blingeasy all of the
license rights granted herein. You agree not to submit material that
is unlawful, obscene, defamatory, libelous, threatening,
pornographic, harassing, hateful, racially or ethnically offensive,
or encourages conduct that would be considered a criminal offense.
Blingeasy does not endorse any User Submission or any opinion,
recommendation, or advice expressed therein, and Blingeasy expressly
disclaims any and all liability in connection with User Submissions.
You understand that when using Blingeasy, you will be exposed to
User Submissions from a variety of sources, and that Blingeasy is
not responsible for the safety, or intellectual property rights of
or relating to such User Submissions. You may be exposed to User
Submissions that are inaccurate, offensive, indecent and you agree
to waive, and hereby do waive, any legal or equitable rights or
remedies you may have against Blingeasy and agree to indemnify and
hold its owners, affiliates, employees, agents and/or licensors,
harmless to the fullest extent allowed by law regarding all matters
related to your use of the Website. You acknowledge that access to
certain photos which may be available through the Website might
depict violence, nudity and sexual acts, or other sexual material is
permitted only if you are over the minimum age applicable in your
jurisdiction 18 or 21.
3. Terms of Service
Blingeasy reserves the right to remove or replace any uploaded files,
and assumes no liability for lost registration links or misplaced file
URLS. The changing of Blingeasy linking codes is prohibited without
prior permission.

2 Files that are pedophiliac. persons under the age of 18 either posing
as "models" or taking part in otherwise sexually implicit or explicit
situations.
3 Files that are illegal and/or are in violation of any United States
laws pertaining to digital content usage.
4 Files that are pornographic. This includes, files depicting genitalia,
nudity, or sexual situations.
5.Files that infringe on the copyright laws. This includes copyrighted
photographs, as well as files for which user lacks usage and/or distribution
permissions.
6 Files that are not of the allowed file types. This includes archived
non-image files.
Files whose intended use or purpose is to harass individual or multiple
persons.
7 the promotion of products or services through direct advertisements
for the purpose of commercial profit, without first attaining the permission
of Blingeasy. This includes, but is not limited to, email spam and banner
advertisements.
4. Claims of Copyright
Or Intellectual Property Infringement
We respect the intellectual property of others, and we ask our users
to do the same. If you believe that your work has been copied or
your intellectual property rights have been otherwise violated,
please provide us with the following information:
an electronic or physical signature of the person authorized to act
on behalf of the owner of the copyright or other intellectual
property interest.
a description of the copyrighted work.
a description of where the material that you claim is infringing is
located on the site.
your address, telephone number, and email address.
a statement by you that you have a good faith belief that the
disputed use is not authorized by the copyright owner, its agent, or
the law.

5. Copyright Infringement.
Blingeasy respects the intellectual property rights
of others. However, you agree that Blingeasy is not
responsible for any violations of any intellectual property rights in
any images or content posted to Blingeasy. You understand
that by using these Services that your images will be publicly available
to others and that Blingeasy has no obligation to prevent
the unauthorized copying, dissemination, alternation or other use of
your images. If you believe that your intellectual property rights have
been infringed by another party please contact us
Blingeasy reserves the right
at all times to terminate your account, and delete any and all User
Content at, in whole or in part, for any reason including, but not limited
to, violations of these Terms of Service. If you do violate these Terms
of Service, Blingeasy reserves the right to share any information with
any third party. In addition, Blingeasy reserves the
right at all times to disclose any User Content as necessary to satisfy
any law, regulation, governmental request or partner request, in its
sole discretion.
6. Cookies
Blingeasy places cookies on your computer to retain your individual
preferences and improve your user experience on our website, as well
as to tell us what features of our sites are most popular. We do not
store any personal information in cookies, nor do we use cookies to
obtain any personal information from you.
Affiliates and advertisers, product and service providers may also use
their own cookies when you interact with their sites.
7. Indemnification.
You agree to defend, indemnify, and hold harmless Blingeasy and its
subsidiaries and other affiliated companies, and their employees, officers,
directors, contractors, agents, licensors and suppliers, from all liabilities,
losses, damages, claims, costs and expenses, including reasonable attorney's
fees, that arise from (i) use or misuse of the Services or any person
to whom you have granted access to the Services, (ii) your violation
of any of these Terms of Service, or (iii) any other activity related
to your account (including negligent or wrongful conduct). Blingeasy
reserves the right, at it own expense, to assume the exclusive defense
and control of any matter otherwise subject to defense by you, in which
event you will cooperate with Blingeasy and its counsel in the conduct
of such defense.
